PPE Stockpile Regulation
Summary of Proposed Changes for Hospitals and Nursing Homes:
- Hospitals and nursing homes are required to maintain a 60-day supply of PPE based on specified calculations.
- Storage conditions and emergency provisions are outlined.
- Compliance with new PPE stockpile requirements is required within 90 days of the Department’s determination.
- Facilities are advised on shelf life management and encouraged to rotate inventory.
- Facilities are encouraged to rotate through stockpiles to reduce waste.
- Nursing homes are already obligated to maintain a two-month supply of PPE, aligning with these regulations.
Compliance Schedule:
- The regulations became effective on February 28, 2024 when the Notice of Adoption was published in the New York State Register.
- Hospitals and nursing homes will have 90 days to comply with new PPE stockpile requirements after the Department’s determination of staffed beds.
Penalties:
- Failure to comply may result in the revocation, limitation, or suspension of a facility’s license, with a 14-day grace period for the first violation.
